Archivy Terms of Service

Welcome to Archivy (the “Service”), operated by FourBrains (“we”, “us”, or “our”). These Terms of Service (“Terms”) govern your access to and use of Archivy via iOS, Android, and Web platforms. By using the Service, you agree to be bound by these Terms and the Apple Media Services Terms and Conditions.

1. Service Overview & Scope

Archivy is a personal organization and discovery service. Key features include:

Organizing metadata from Instagram links
•
Location-based recommendations
•
AI-powered summarization and categorization
The Service is available on iOS, Android, and Web. Access is permitted in countries where the necessary app stores and FourBrains’ services are supported.
Permitted Use: The Service is intended solely for personal archival and organization purposes. You may not use Archivy for commercial, business, resale, or third-party distribution purposes.

2. Eligibility & Account Management

•
You must be at least 13 years old to use the Service. Where local law sets a higher digital consent age, that higher threshold applies.
•
Account registration uses OTP-based login (email-based magic link).
•
You are responsible for keeping your account credentials and device secure.
•
Account sharing or transferring is prohibited.
•
We reserve the right to suspend or terminate accounts if you violate these Terms, engage in abuse, or remain inactive for extended periods.
•
Account deletion: upon user request, we remove user-related data without undue delay and purge from backups within 30 days, except where retention is required for fraud prevention, accounting, or other legal obligations.
•
Sanctions & export controls: you may not use the Service if you are located in an embargoed/sanctioned country or are on a restricted parties list under applicable law.

3. Subscriptions & Payment Terms

•
We offer auto-renewable subscription plans, such as:

Pro Plan — US$1/month (includes 30 credits; bundle-discounted rate)

Max Plan — US$5/month (unlimited usage; subject to Fair Use and rate limits)

Unit pricing & regional variation: A baseline of US$1 per 10 standalone credits (≈ US$0.10/credit) may apply where offered. Per‑unit equivalents and final prices are shown at purchase time and may vary by region, tax, and offer. Credits included in subscriptions (e.g., Pro) reflect discounted bundle pricing and do not indicate the standalone per‑credit price.
•
Subscription periods are monthly unless otherwise specified.
•
Free trial periods may be offered to eligible users, with auto‑renewal to a paid plan unless canceled before the trial ends.
•
Subscriptions automatically renew unless canceled at least 24 hours before the end of the active period.
•
Subscriptions will be charged to your App Store/Google Play account.
•
You can manage or cancel subscriptions through your device’s App Store or Google Play settings.
•
In‑app disclosures: purchase and subscription management screens display title, duration, price (and per‑unit where appropriate) and provide functional links to the Privacy Policy and Terms (including Apple’s Standard EULA).
•
Refunds are generally not available, except as required by applicable law.
•
AI analysis failures: in the event of system errors or unusable premium AI results, consumed credits may be restored as a goodwill remedy. This does not affect billing handled by Apple/Google; store refunds follow App Store/Google Play policies.
•
Taxes, fees, and currency conversion may apply according to your location.
•
If a payment fails, access to subscription features may be restricted until the issue is resolved.
•
Fair Use for unlimited plans: unlimited usage is subject to reasonable rate limits and abuse‑prevention thresholds, disclosed in‑app.

3.1 Credits Usage & Expiration

•
What consumes credits ("AI operations"):
◦
Instagram Link Processing: 1 credit per link processed (initial summary/enrichment). Batch imports consume 1 credit per link.
◦
Location‑based Recommendations/Queries: 1 credit per query (per submitted search or recommendation request).
◦
Re‑runs: user‑initiated re‑processing counts as a new request (1 credit), except when prior runs failed due to system errors; in such cases, credits may be restored.
•
Included vs. standalone credits: credits included with subscriptions expire at the end of the billing period and do not roll over. Standalone purchased credit packs (if offered) remain valid for 12 months from purchase and may be used without an active subscription.
•
Cancellation: canceling a subscription stops future renewals. You keep access and any included credits until the period ends; any unused included credits expire at the end of the period. Standalone credits remain until their 12‑month validity ends.
•
Transparency: in‑app counters show credits available, pending, and consumed. Credits have no cash value and are not redeemable for money except where required by law.

3.2 Unlimited Plan — Fair Use Examples

To protect service stability, the Max plan applies practical limits, subject to change with reasonable notice and reflected in‑app:

Per‑hour: up to 60 AI operations/hour per account.
•
Per‑day: up to 1,000 AI operations/day per account.
•
Per‑month: up to 20,000 AI operations/month per account.
Automatic rate‑limiting, anomaly detection, and temporary throttling may apply in cases of abuse or unusual activity.

4. Rules of Use & Prohibited Conduct

You must not:
•
Upload or submit spam, unlawful, or harmful content.
•
Use Instagram links in violation of Instagram’s terms or applicable law.
•
Infringe on others’ intellectual property or privacy rights.
•
Use automated systems (bots), scraping, or reverse engineering to access or use the Service.
•
Interfere with the normal operation of the Service or degrade user experience.
•
Resell access, share accounts, or use the Service to build or train a competing service.

4.1 User‑Generated Metadata Obligations

•
If you add notes, tags, categories, or annotations to links, you must ensure that such metadata does not infringethird‑party rights (e.g., defamation, privacy, trademarks, or confidential information).
•
You are responsible for removing or correcting metadata upon request from rights holders or affected parties and must cooperate with our review or takedown processes.

5. Intellectual Property

•
All rights to Archivy—including its design, branding, and AI systems—are owned by FourBrains.
•
Intermediary processor: Archivy processes user‑submitted links using AI to generate summaries and metadata. We do not permanently store or republish original third‑party media (e.g., images/videos/text from Instagram posts). Only AI‑processed outputs and metadata are stored on our servers.
•
By submitting content (e.g., links, annotations, metadata), you grant FourBrains a non‑exclusive, worldwide, royalty‑free license to process, reproduce, display, distribute, and create derivative works for providing and improving the Service.
•
AI outputs license to you: AI‑generated outputs are licensed to you on a non‑exclusive basis; similar outputs may be generated for others.
•
Original third‑party content remains the property of its respective creators. Users are responsible for ensuring their use complies with applicable third‑party platform terms (e.g., Instagram).

6. Third‑Party Services & API Integrations

•
Archivy relies on third‑party services (e.g., hosting, database, analytics, AI processing, and maps/places) including providers such as Supabase, Google Places/Vision/Gemini, and Google Maps SDK.
•
Google Maps/Places compliance: we may store Google Place IDs indefinitely and refresh place details per Google policies; other Places content is not stored beyond permitted caching limits and is displayed with required Google attribution.
•
Features may depend on the availability and policies of those services. If external services change or cease, Archivy’s functionality may be limited accordingly. FourBrains is not liable for those changes.

7. Privacy & Data Processing

•
Please see our Privacy Policy.
•
We collect minimal information (e.g., your email for login).
•
Location data is processed on your device when applicable and is not stored on our servers unless explicitly stated.
•
Transient processing: to deliver the Service, we may use short‑lived processing caches (e.g., ≤ 24 hours) and operational logs (e.g., ≤ 30 days) consistent with these Terms and our Privacy Policy. These do not include persistent storage of original third‑party media.
•
We may use analytics, crash reporting, and monitoring tools to improve the Service.

8. Content Removal & Rights Holder Notices

•
If you believe your rights have been infringed, contact us using the details in section 14 with: your identity and contact details, a description of the work and allegedly infringing material (including links/identifiers), and a good‑faith statement of unauthorized use.
•
We will review valid reports and may remove or disable access to material alleged to be infringing.
•
You agree to cooperate in investigations, including providing information reasonably required.

9. Service Changes & Discontinuation

•
We may update, modify, or discontinue features at any time, including changing prices, bundles, and benefits(with reasonable prior notice where required).
•
Beta features may be released on a trial basis.
•
If we plan to discontinue the entire Service, we will provide reasonable notice where feasible.
•
We are not responsible for loss of functionality or data due to service changes, to the extent permitted by law.

10. Disclaimers & Limitation of Liability

•
The Service is provided “as is” and “as available”, with all faults.
•
We disclaim all warranties of any kind, whether express or implied, to the maximum extent permitted by law.
•
FourBrains is not liable for losses resulting from loss of data, downtime, or third‑party links or services.
•
Consumer law safeguard: Nothing in these Terms limits rights that cannot be excluded under applicable consumer laws.
•
Our maximum liability is limited to the amount you have paid us in the prior 12 months, to the extent permitted by law.

10.1 AI Outputs & User Responsibility

•
AI‑generated summaries/recommendations may be inaccurate, incomplete, or outdated. They are provided for informational purposes only.
•
You must review and verify outputs before relying on them. Do not use the Service for safety‑critical decisions or professional advice without independent verification.
•
We are not responsible for decisions made based on AI outputs.

10.2 Location & External Data Accuracy

•
Recommendations and metadata may rely on external sources (e.g., maps, listings). Such data can change without notice, may be delayed, or inaccurate due to geolocation limits (GPS/Wi‑Fi), geocoding variance, or merchant changes.
•
We do not guarantee accuracy, completeness, availability, or real‑time currency of external or location‑based data.

11. Indemnification

You agree to defend, indemnify, and hold harmless FourBrains, its employees, contractors, and agents from any claims, liabilities, damages, or costs (including attorneys’ fees) arising from:

Your breach of these Terms,

Your use of the Service, or
•
Any violation of law or rights by you.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Republic of Korea.
•
Courts in Seoul, Korea have jurisdiction, provided that consumers in the EEA/UK/Canada may bring claims in their local courts where required by local consumer law.
•
In case of translation inconsistencies, the English version controls.

13. Changes to Terms & Notice

•
We may revise these Terms at any time.
•
Notice of updates will be sent via email or via in‑app notification.
•
Changes become effective on the date posted. Continued use of the Service constitutes acceptance of revised Terms.
