Copyright Policy for Archivy by FourBrains

This policy sets out how FourBrains responds to claims of copyright infringement concerning content accessible through the Archivy service and how it handles takedown and counter notices.

1. Overview

Under the U.S. Digital Millennium Copyright Act (DMCA), FourBrains aims to maintain Safe Harbor protection by implementing a transparent, fair, and effective takedown process for alleged copyright infringement. This policy also extends to similar global notice-and-takedown regimes.

2. About Archivy Content Handling

Archivy uses only user-submitted Instagram post links and does not store, cache, reproduce, or distribute original Instagram media or text.
Only extracted metadata (e.g. location names, product brands, keywords) is used, processed via AI tools like Google Gemini or on-device. Full posts are not retained.
All content displayed within Archivy always includes a hyperlink to the original Instagram post, ensuring correct attribution.

3. How to Submit a DMCA Notice

If you believe your copyrighted work is being used without authorization via the PINS service, please send a written notice including:
1.
Your name, address, telephone number, and email.
2.
A description of the copyrighted work.
3.
URL(s) within Archivy containing the alleged infringement (e.g., link to metadata or link item).
4.
A statement under penalty of perjury that you have a good-faith belief usage is unauthorized.
5.
A statement that the information in the notice is accurate and that you are the copyright owner (or authorized to act).
6.
Your electronic or physical signature.

4. Response to Valid Notices

Upon receipt of a valid DMCA notice, FourBrains will:
Promptly disable access to the referenced metadata link within Archivy.
Notify the User associated with the link that their submission has been taken down.
Retain records of the notice in case of future reference.

5. Filing a DMCA Counter-Notice

If you believe your content was removed in error, you may submit a counter-notice including:
Your contact information.
Identification of the removed material and location prior to removal.
A statement consenting to jurisdiction in your local U.S. federal district court (or equivalent).
A statement under penalty of perjury that the removal was a mistake or misidentification.
Your physical or electronic signature.
Upon receipt, FourBrains will notify the original submitter and, absent further legal notice, restore access within 10 to 14 business days.

6. Repeat Infringer Policy

FourBrains reserves the right to terminate accounts or subscriptions of users who repeatedly infringe copyright. This action may occur without prior notice in compliance with DMCA Safe Harbor provisions  .

7. Fair Use Consideration

We respect fair use and will evaluate claims carefully. If content appears to be lawful under copyright exceptions (e.g., review, commentary), we may challenge takedown requests or require additional verification before removal  .

8. International Application

Although the DMCA is U.S.-specific, this policy is intended to reflect best practices under similar copyright frameworks in other jurisdictions, ensuring consistent and fair responses globally.
